1. SERVICE DESCRIPTION

TXWS offers two distinct one-on-one services:

A. PRIVATE TUTORING (Students)

Individual instruction for high school, college, and exceptional younger students in:

• Essay writing (academic, not highly technical research papers)

• College application essays

• Poetry

• Business writing (college students)

• Reading comprehension and critical thinking

• Editing/feedback on creative writing

B. ONE-ON-ONE WRITING COACHING (Adults)

Individual coaching for adults who want to write compelling, authentic stories for:

• Personal edification and growth

• Love of writing

• Business storytelling and brand narratives

• Finding authentic voice

• Specific writing projects (memoir, essays, etc.)

2. WHO QUALIFIES

PRIVATE TUTORING:

Primary Focus:

• High school students (grades 9-12)

• College/University students

Exceptions (Qualification Required):

• Middle school students (grades 6-8) ONLY if gifted/advanced

• Elementary students (grades K-5) ONLY if gifted/advanced

Qualification Process for Younger Students:

• Initial consultation required

• Student assessment of writing level

• Student writing samples

• Parent/guardian interview

• Letter of recommendation from teacher

• TXWS determines if student is appropriate fit

ONE-ON-ONE COACHING:

For Adults Who:

• Want to write compelling, authentic stories

• Seek to find their authentic voice

• Have specific writing projects

• Need accountability and feedback

• Want to improve their narrative/storytelling skills

Qualification Required:

All adult coaching clients must complete qualification interview before engagement (same process as all TXWS services - see Client Qualification Questions).

3. WHAT'S INCLUDED / NOT INCLUDED

PRIVATE TUTORING INCLUDES:

✅ One-on-one 45-minute sessions

✅ Customized instruction based on student needs

✅ Feedback on assignments related to tutoring sessions

✅ Resources and materials as needed

✅ Communication with parents/guardians (for minor students)

TUTORING DOES NOT INCLUDE:

❌ Writing papers FOR the student

❌ Extensive editing of long manuscripts

❌ Highly technical research paper assistance

❌ Teaching creative/imaginative fiction writing from scratch

❌ Test prep (SAT, ACT writing sections)

ONE-ON-ONE COACHING INCLUDES:

✅ One-on-one 45-minute sessions

✅ Customized coaching based on goals

✅ Feedback on up to 5 documents during coaching engagement (up to 2,000 words each)

✅ Accountability and support

✅ Resources and guidance

COACHING DOES NOT INCLUDE:

❌ Generic "content writing" instruction

❌ Social media strategy

❌ Technical writing instruction

❌ Line-by-line editing services (available separately)

❌ Publishing services or agent connections

4. SESSION FORMAT

SESSION LENGTH:

All sessions are 45 minutes

DELIVERY OPTIONS:

Video Call:

• Google Meet or Microsoft Teams

• Available to all students/clients regardless of location

In-Person (Brevard County, Florida only):

• Available for local students/clients

• Location to be determined (TXWS office, library, coffee shop, or student's location if appropriate)

SCHEDULING:

• Sessions scheduled at mutually convenient times

• Standing weekly time slot recommended but flexible

• Calendar invitations sent with meeting links

5. PACKAGE STRUCTURE & PRICING

PRIVATE TUTORING:

Middle School / High School Students:

• 6-session package: $450 ($75/session)

• 12-session package: $840 ($70/session - save $60)

College Students:

• 4-session package: $320 ($80/session)

• 8-session package: $600 ($75/session - save $40)

ONE-ON-ONE COACHING (Adults):

• 4-session package: $600 ($150/session)

• 8-session package: $1,120 ($140/session - save $80)

• 12-session package: $1,620 ($135/session - save $180)

BETWEEN-SESSION SUPPORT (Adults Only):

• Included: Feedback on up to 5 documents during coaching engagement

• Add-on: Additional 5-document feedback package for $250

6. PAYMENT TERMS

PAYMENT DUE:

Full package payment due before first session, unless opted into split payment process.

PAYMENT OPTIONS:

A. Pay in full upon registration

B. Split payment (for 8+ session packages only):

•    50% due before first session

•    50% due before midpoint session

•    $25 late fee if second payment late

ACCEPTED PAYMENT METHODS:

Visa, Mastercard, ACH, Apple Pay, Stripe

PACKAGE EXPIRATION:

Packages must be used within:

• 4-session packages: 8 weeks

• 6-session packages: 12 weeks

• 8-session packages: 16 weeks

• 12-session packages: 20 weeks

Extensions available for $50/month if needed due to illness, emergency, or scheduling conflicts.

7. SCHEDULING & ATTENDANCE

SCHEDULING:

• Student/client schedules sessions in advance

• Standing weekly time preferred but flexible

• Must schedule next session before ending current session

RESCHEDULING POLICY:

First Reschedule/Cancellation:

• 24+ hours notice: Free reschedule

• Less than 24 hours notice: Warning (no fee)

Second Reschedule/Cancellation (same package):

• 24+ hours notice: Free reschedule

• Less than 24 hours notice: $25 fee

Third Reschedule/Cancellation (same package):

• 24+ hours notice: $25 fee

• Less than 24 hours notice: Session forfeited (no refund, counts as used)

No-Show (doesn't arrive within 10 minutes):

• First time: Warning, session forfeited

• Second time: Session forfeited + $50 fee for future sessions

• Third time: Remaining package forfeited, termination of service

CHRONIC PATTERN:

Pattern of missed/rescheduled sessions (3+ in any package) may result in service termination with prorated refund of unused sessions minus administrative fee.

TXWS CANCELLATIONS:

If TXWS needs to cancel:

• Client receives priority rescheduling within 48 hours

• Session added to end of package at no charge

• If unable to reschedule promptly, prorated refund for that session

8. PARENT/GUARDIAN COMMUNICATION (For Minor Students - Under 18 Years Old)

Communication Expectations:

• Parents/guardians kept informed of progress

• Brief check-ins after sessions (if parent present)

• Email updates as needed

• Progress reports available upon request

Parent Presence:

• Parents may be present during sessions (especially for younger students)

• For older students (high school), parent presence optional

• Student and parent decide what works best

Confidentiality:

• Student work and discussions generally shared with parents

• Age-appropriate privacy respected for older students

• Academic integrity issues will be reported to parents

9. HOMEWORK & ASSIGNMENTS

TUTORING:

• Homework may be assigned between sessions

• Students expected to complete assignments

• Assignments reviewed in next session

• Feedback provided on work related to tutoring goals

COACHING (Adults):

• Writing exercises may be assigned

• Clients encouraged to work on projects between sessions

• Drafts reviewed within document feedback allowance

• Accountability for client's own goals and progress

NOT INCLUDED:

• Extensive editing or rewriting of client work

• Writing assignments FOR the student/client

• Unlimited feedback outside of sessions

10. DOCUMENT FEEDBACK (ADULT COACHING ONLY)

INCLUDED IN COACHING PACKAGES:

Feedback on up to 5 documents during coaching engagement

"Document" Defined:

One piece of writing up to 2,000 words

• Essay, article, blog post, brand narrative section

• Multiple short pieces may count as one document if under 2,000 words total

Feedback Includes:

• Overall impressions and suggestions

• Strengths and areas for improvement

• Specific recommendations

• Written comments (1-2 pages typically)

Turnaround Time:

5-7 business days from submission

ADD-ON PACKAGE:

Additional 5-document feedback package: $250

• Can be purchased anytime during or after coaching

• Same terms as included feedback

11. REFUND & CANCELLATION POLICY

CANCELLATION BY STUDENT/CLIENT (Must Be in Good Standing):

Before first session (Must give at least 60 minutes notice):

• Full refund minus $50 administrative fee

After first session:

• Refund of unused sessions at per-session package rate

• Example: 6-session package ($450), used 2 sessions

  • Refund: 4 sessions x $75 = $300

After 50% of package used:

• Refund of unused sessions minus 10% administrative fee

• Example: 8-session package ($600), used 5 sessions

  • Remaining: 3 sessions x $75 = $225

  • Minus 10% admin fee ($22.50)

  • Refund: $202.50

Refund Processing:

All refunds processed within 30 business days of cancellation request.

Cancellation Notice:

In order to cancel a program, course, or session, clients must provide written notice via email to [email protected] with the Subject: Cancellation Requested

TERMINATION BY TXWS:

TXWS reserves right to terminate services for:

• Pattern of missed/rescheduled sessions (3+ in any package)

• Abusive, threatening, or harassing behavior

• Parent/student boundary violations

• Requesting unethical assistance (writing papers FOR student, cheating)

• Non-payment or pattern of late payment

• Misrepresentation of needs or intentions

• Any behavior violating this agreement

Refund Policy Should TXWS Terminate:

A. TXWS'S DECISION (capacity, emergency, no client wrongdoing):

• Full refund of unused sessions at per-session rate

B. CLIENT/STUDENT BREACH:

• No refund of used sessions

• Refund of unused sessions minus 25% administrative fee

C. MUTUAL AGREEMENT:

•  Refund of unused sessions at per-session rate

•  Both parties sign mutual release

12. ACADEMIC INTEGRITY

TXWS IS COMMITTED TO ACADEMIC INTEGRITY:

What TXWS Will Do:

✅ Teach writing skills and techniques

✅ Provide feedback and suggestions

✅ Help students understand assignments

✅ Guide students through writing process

✅ Edit and proofread student's own work

What TXWS Will NOT Do:

❌ Write papers or assignments FOR students

❌ Extensively rewrite student work (that's the student's job)

❌ Help students cheat or plagiarize

❌ Tolerate any form of plagiarism (another person’s writing, AI-written content

❌ Provide answers to take-home exams

❌ Complete homework assignments

If Asked to Violate Academic Integrity:

• TXWS will decline

• Parents will be notified (if minor)

• Service may be terminated

• No refund if termination due to academic integrity violation

13. CONFIDENTIALITY

TXWS COMMITMENT:

• Student/client work kept confidential

• Sessions and discussions private

• Materials not shared without permission

EXCEPTIONS:

• Parent/guardian communication (for minors)

• Safety concerns or legal obligations

• Academic integrity violations (reported to parents/school if appropriate)

STUDENT/CLIENT RESPONSIBILITY:

• May share their own work as they wish

• Session content remains confidential

14. INTELLECTUAL PROPERTY

STUDENT/CLIENT WORK:

Students/clients retain full ownership of their work. TXWS may NOT use student/client work without written permission.

TXWS MATERIALS:

Resources, handouts, and materials provided by TXWS are for personal use only. These materials may not be shared, reproduced, or used for commercial purposes.

15. LIABILITY & WARRANTIES

TXWS WARRANTS:

• Professional, skilled instruction

• Reasonable care in teaching and feedback

• Original materials and guidance

TXWS IS NOT LIABLE FOR:

• Student's grades or academic outcomes

• Acceptance to colleges or programs

• Client's publication success

• Individual learning outcomes

• Technical issues on student/client end

LIMITATION OF LIABILITY:

TXWS's total liability shall not exceed amount paid by student/client for services.

16. PARENTAL CONSENT (For Minor Students)

For students under 18:

Parent/guardian acknowledges:

• They have reviewed and agreed to these Terms & Conditions

• They consent to student participating in tutoring

• They understand payment obligations

• They will communicate with TXWS regarding student progress

• They understand and agree to cancellation/refund policies

Parent/Guardian Contact Information Required:

• Phone

• Relationship to student

17. FORCE MAJEURE

Neither party liable for failure to perform due to circumstances beyond reasonable control:

• Natural disasters

• Pandemics or public health emergencies

• Internet or technology failures

• Personal illness or family emergency

If force majeure prevents completion of package:

• Extend package expiration at no charge, OR

• Prorated refund for unused sessions

18. DISPUTE RESOLUTION

INFORMAL RESOLUTION:

Parties agree to first attempt informal resolution through good-faith discussion.

MEDIATION:

If informal resolution fails, parties agree to mediation before litigation.

GOVERNING LAW:

Agreement governed by laws of the State of Florida.

JURISDICTION:

Any legal action must be brought in Brevard County, Florida.

19. MODIFICATIONS TO TERMS

TXWS reserves right to modify these Terms & Conditions with 30 days' notice.

Modifications will not affect services already in progress.

Students/clients engaging after modification date agree to updated terms.

20. ENTIRE AGREEMENT

These Terms & Conditions, together with package purchase confirmation, constitute entire agreement regarding tutoring/coaching services.

21. SEVERABILITY

If any provision found unenforceable, remaining provisions remain in full effect.

23. ACCEPTANCE

By purchasing a tutoring or coaching package, student/client (and parent/guardian if minor) acknowledges they have read, understood, and agree to these Terms & Conditions.
