UNDERSTANDING OUR RECORDING POLICY

All client interviews and conversations are recorded as an essential part of The Experiential Writing Studio's service delivery process. This page explains why I record, how recordings are used, your rights, and what you're consenting to when you work with me.

WHY I RECORD

Recording is essential to my experiential writing process and is non-negotiable. Without recording, I cannot provide our services.

I record all interviews and conversations to:

  • Ensure accuracy in capturing your story, voice, and specific details

  • Reference your exact words and phrasing when creating content

  • Review complex information or technical details discussed during interviews

  • Maintain quality control and consistency in content creation

  • Protect both parties by having a clear record of what was discussed

My entire approach depends on capturing your authentic voice and referring back to exactly what you said. This isn't about surveillance—it's about honoring your words and getting your story right.

WHAT GETS RECORDED

The following interactions will be recorded:

  • Initial consultation calls (if applicable)

  • All scheduled interviews for content creation

  • Brand storytelling sessions

  • Project planning discussions

  • Feedback and revision conversations

  • Any other verbal communication related to your project or service

You'll Always Know When Recording Is Active

I'll notify you at the beginning of each call or meeting that recording is in progress. By remaining on the call after notification, you consent to being recorded.

HOW RECORDINGS ARE USED

Permitted Uses

Your recordings will be used solely for the following purposes:
  • Creating your content (articles, brand narratives, website copy, etc.)

  • Verifying facts, quotes, and details you provided

  • Ensuring accuracy in representing your voice and story

  • Quality assurance (internal use only)

  • Resolving disputes or clarifying project scope

What I Don't Do With Your Recordings

Your recordings will NOT be used for:
  • Marketing or promotional purposes without your explicit written consent

  • Sharing with third parties (except as required by law)

  • Creating content for other clients

  • Any purpose outside the scope of your service agreement

STORAGE & SECURITY

How I Store Your Recordings

  • All recordings are stored in secure, encrypted cloud storage

  • Access is restricted to me only (Meredith L. McGuire McConn)

  • Recordings are labeled with your name and date for easy reference

  • Storage complies with industry-standard security practices

Security Measures I Use

  • Encrypted transmission during upload

  • Password-protected storage accounts

  • Regular security audits and updates

  • Secure backup systems

  • Limited access protocols

RETENTION & DELETION

How Long I Keep Recordings

Active Clients:
  • Recordings kept for the duration of your service agreement

  • Recordings retained for 12 months after final deliverable is provided

  • Extended retention available upon written request

Former Clients:
  • Recordings automatically deleted 12 months after project completion

  • Earlier deletion available upon written request

Subscription Clients:
  • Recordings retained for duration of subscription plus 12 months

  • Recordings deleted 12 months after subscription ends

Request Deletion Anytime

You may request deletion of your recordings at any time by:
  • Emailing me at: [email protected]

I'll process deletion requests within 30 business days. Please note that requesting deletion before project completion may affect my ability to complete your project accurately.

YOUR RIGHTS

As the subject of these recordings, you have the following rights:

Right to Access

  • You may request copies of your recordings at any time

  • I'll provide copies within 14 business days of request

  • Provided in commonly used audio format (MP3 or similar)

Right to Correction

  • If you believe I misunderstood or misrepresented something you said, you may request I review the recording

  • I'll make corrections to content based on recording review

Right to Deletion

  • You may request deletion of your recordings at any time

  • I'll complete deletion within 30 business days

  • Early deletion may affect project completion

Right to Revoke Consent

  • You may revoke recording consent at any time

  • Revocation must be in writing

  • Services will be terminated if consent is revoked (recording is essential to my process)

  • Refunds subject to cancellation policy in your service agreement

Right to Complain

  • You may file complaints about recording practices

  • I'll investigate and respond within 30 days

LEGAL COMPLIANCE

Federal and State Laws

TXWS complies with all applicable federal and state recording laws, including:
  • Federal Wiretap Act (18 U.S.C. § 2511)

  • State consent requirements for recording

  • Data privacy and security regulations

  • Industry best practices for data protection

Florida Two-Party Consent

Florida is a two-party consent state, meaning all parties must consent to recording. By signing the Recording Consent & Release Form, you provide the required consent under Florida law.

Interstate Recordings

If you are located in a different state, I will comply with the more restrictive law between Florida and your state of residence.

The Experiential Writing Studio (TXWS), operated by Meredith L. McGuire McConn of Oceans Enterprises Consulting, LLC, records all client interviews and conversations as an essential part of our service delivery process. This Recording Consent & Release Form outlines your rights and our practices regarding these recordings.

1. PURPOSE OF RECORDING

TXWS records all interviews and conversations with clients for the following purposes:

PROHIBITED USES:

Your recordings will NOT be used for:

  • Creating content for other clients

  • Any purpose outside the scope of your service agreement

ACTIVE CLIENTS:

  • Recordings kept for the duration of your service agreement

  • Recordings retained for 12 months after final deliverable is provided

FORMER CLIENTS:

  • Recordings automatically deleted 12 months after project completion

  • Earlier deletion available upon written request

SUBSCRIPTION CLIENTS:

  • Recordings retained for duration of subscription plus 12 months

  • Recordings deleted 12 months after subscription ends

DELETION PROCESS:

You may request deletion of your recordings at any time by:

Deletion requests will be processed within 30 business days. Please note that requesting deletion before project completion may affect our ability to complete your project accurately.

6. YOUR RIGHTS

If you have concerns about how your recordings are being used or stored, please contact us immediately at [email protected]. We will work with you to resolve any issues promptly.

FORMAL COMPLAINTS:

If informal resolution is unsuccessful, you may:

  • File a formal complaint in writing

  • Request mediation

  • Seek legal counsel

GOVERNING LAW:

This Recording Consent & Release Form is governed by the laws of the State of Florida. Any disputes will be resolved in Brevard County, Florida.

10. MODIFICATIONS

TXWS reserves the right to modify this Recording Consent & Release Form with 30 days' written notice to active clients.

Material changes to recording practices will require new consent.

Continued participation in recorded sessions after notification of changes constitutes acceptance of modified terms.

By signing below, I acknowledge that:

  • I have read and understand this Recording Consent & Release Form

  • I voluntarily consent to the recording of all conversations and interviews with TXWS

  • I understand that recording is essential to TXWS's service delivery

  • I understand that refusal to consent or revocation of consent will result in service termination

  • I understand my rights regarding access, correction, and deletion of recordings

  • I agree to all terms and conditions outlined in this document
